Terms of Service and End User Licence Agreement (EULA) for Athar

These Terms of Service and End User Licence Agreement ("Terms") govern your use of Athar: Echoes of Time ("Athar"), which is developed and operated by Siraaj Studios Ltd ("Siraaj Studios", "we", "our", or "us"), and the services provided through our app, website, and related online services (collectively, the "Service").

By creating an account, downloading, accessing, or using Athar, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum legal age required to use online services in your jurisdiction, to create an account and use the Service.

If you are under the age required to enter a legally binding agreement in your jurisdiction, you must have permission from a parent or legal guardian where required by law.

By using Athar, you confirm that you meet the applicable age requirements.

2. Licence to Use Athar

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, install, and use Athar for personal, non-commercial purposes.

This licence does not transfer ownership of Athar or any of its intellectual property to you.

You may not:

copy, reproduce, distribute, sell, rent, sublicense, or commercially exploit Athar except where expressly permitted;
modify or create derivative works from Athar;
reverse-engineer, decompile, disassemble, or attempt to obtain the source code of Athar, except where applicable law expressly permits this;
circumvent security measures or technical restrictions;
use Athar to develop or operate a competing service; or
use automated systems to interact with Athar without our permission.

3. Account and Access

Certain features of Athar require an account.

You are responsible for maintaining the security of your account and login credentials.
You are responsible for activity carried out through your account, except where caused by our own failure to take reasonable security measures.
You must provide accurate information where we require information to create or maintain your account.

If you believe that your account has been compromised, please contact us as soon as reasonably possible.

We reserve the right to suspend or restrict accounts where reasonably necessary to protect the Service, its users, or its security.

4. Acceptable Use and Fair Play

You agree to:

use the Service only for lawful purposes;
respect the rules and spirit of the game;
treat other players respectfully;
avoid behaviour that disrupts or harms the experience of other players;
respect the historical, cultural, and religious figures and subjects represented within Athar, including but not limited to Prophets, Companions (Sahaba), scholars, and other figures of historical significance; and
follow any additional rules communicated within the Service.

You may not:

cheat or exploit unintended game mechanics;
use bots, scripts, automation, or unauthorised third-party software;
manipulate matchmaking, rankings, results, or other competitive systems;
exploit bugs or vulnerabilities for an unfair advantage;
interfere with or manipulate the Service, servers, networks, or game data;
attempt to gain unauthorised access to another account or part of the Service;
reverse-engineer or decompile any part of the Service except where applicable law expressly permits this;
harass, threaten, abuse, or deliberately disrupt other players;
impersonate another person, player, or member of the Athar team;
use usernames, profile content, or other material that is offensive, abusive, misleading, or otherwise inappropriate;
use the Service to conduct fraudulent or unlawful activities; or
attempt to obtain cards, Virtual Items, currency, subscriptions, or other benefits through unauthorised means.

We may investigate suspected cheating, exploitation, fraud, or other violations and take appropriate action to protect the Service and its players.

5. Intellectual Property

All content, artwork, design, software, game mechanics, cards, names, logos, text, graphics, animations, sounds, features, and other material within Athar ("Game Content") are owned by us or licensed to us.

Your use of Athar does not transfer ownership of any Game Content to you.

You may not reuse, reproduce, modify, distribute, sell, or commercially exploit Game Content without our explicit permission, except where permitted by applicable law.

You are permitted to take screenshots and video recordings of Athar for personal sharing, streaming, reviews, commentary, and other content creation, provided that such use does not imply endorsement by us or otherwise violate these Terms.

6. User and Custom Content

Athar may allow users to create or submit certain content, including usernames, custom cards, descriptions, artwork, or other material ("User Content").

You retain ownership of User Content that you independently own.

By submitting User Content to Athar, you grant us a worldwide, non-exclusive, royalty-free licence to store, display, reproduce, modify, adapt, and use that content as reasonably necessary to operate, maintain, promote, and improve Athar.

This licence does not transfer ownership of your User Content to us.

You are responsible for ensuring that you have the necessary rights to submit your User Content.

7. In-App Progress and Game Content

Athar may store your progress, decks, collection, match history, rankings, preferences, and other game data in the cloud.

We make reasonable efforts to maintain the availability and accuracy of this data, but we cannot guarantee that data will never be lost, corrupted, reset, or otherwise affected by technical problems.

We may modify in-game content, including cards, rules, mechanics, balance, progression systems, game modes, rankings, and other features, as Athar develops.

8. Virtual Currency and Digital Items

Athar may offer virtual currencies, including Dirhams, as well as digital items such as cards, cosmetics, sleeves, profile items, or other in-game content ("Digital Items").

Digital Items are licensed to you for use within Athar. They are not your personal property and do not have monetary value outside the Service.

Unless expressly permitted by us, you may not sell, trade, transfer, or exchange Digital Items outside Athar.

Digital Items cannot be exchanged for real-world money.

9. In-App Purchases

Athar may offer optional purchases through Apple, Google, or other authorised payment platforms. Prices and purchase terms will be shown before you complete a purchase. Payments are processed by the applicable platform and are subject to its terms and policies.

10. Caliph's Court and Subscriptions

Athar may offer optional subscriptions, including Caliph's Court. Subscription benefits may include additional deck slots, access to private or custom matches, profile customisation, cosmetic items, recurring in-game currency, custom-card benefits, or other benefits described at the time of purchase.

11. Refunds

Purchases made through Apple, Google, or another third-party platform are generally subject to that platform's refund procedures.

12. Moderation and Enforcement

We may moderate player behaviour, User Content, usernames, communications, and other activity within Athar.

13. Account Suspension and Termination

You may stop using Athar at any time and may request deletion of your account by contacting us. We reserve the right to suspend or terminate your account where you materially or repeatedly violate these Terms.

14. Service Availability and Changes

Athar is an evolving online game. We may add, modify, suspend, or remove features as appropriate.

15. Third-Party Services

Athar may rely on third-party services, including app stores, payment providers, authentication services, and hosting providers.

16. Privacy

Our collection and use of personal information is described in our Privacy Policy at Privacy Policy.

17. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as available" basis without warranty of any kind.

18. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, or consequential damages resulting from your use of the Service.

19. Indemnity

To the extent permitted by applicable law, you agree to compensate us for reasonable losses, liabilities, claims, and expenses arising from your material breach of these Terms.

20. Changes to These Terms

We may update these Terms from time to time. Your continued use of Athar after updated Terms take effect constitutes acceptance.

21. Apple App Store Additional Terms

If you downloaded Athar through Apple's App Store, Siraaj Studios Ltd is solely responsible for Athar and its content, and Apple has no maintenance, support, or warranty obligations beyond applicable platform terms.

22. Governing Law

For users in the United Kingdom, these Terms are governed by the laws of England and Wales, except where mandatory laws in your country of residence provide otherwise.

23. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
